Judge: Employee not let go over intelligent design

LOS ANGELES (AP) ? A former computer specialist at NASA's Jet Propulsion Laboratory was not dismissed because he advocated his belief in intelligent design while at work, a Superior Court judge has tentatively ruled.

Judge Ernest Hiroshige said Thursday he is leaning in favor of JPL's argument that David Coppedge instead was let go because he was combative and did not keep his skills sharp.

Hiroshige, who presided over the lawsuit's trial in April, ordered a final ruling to that effect be drawn up and distributed within 30 days.

Coppedge's attorney, William Becker, declined to comment until the final ruling is issued. JPL officials also had no immediate comment.

Coppedge, a self-described evangelical Christian, had worked on NASA's Cassini mission to explore Saturn for 15 years until he was dismissed in 2011.

In his wrongful termination suit, Coppedge claimed he was demoted in 2009, then let go for engaging his co-workers in conversations about intelligent design and for handing out DVDs on the topic while at work. Intelligent design is the belief that life is too complex to have developed through evolution alone.

Becker argued at trial that a supervisor told Coppedge to "stop pushing your religion," and that Coppedge was retaliated against for disputing a written warning and filing a lawsuit against the Jet Propulsion Laboratory.

JPL attorney Cameron Fox, however, contended Coppedge was a stubborn and disconnected employee who decided not to heed warnings to get additional training, even when it became clear the Cassini mission would be downsized and computer specialist positions eliminated.

Coppedge often was confrontational and insensitive to customers and colleagues, who had complained about his behavior and his advocacy of intelligent design, Fox said.

Coppedge is active in the intelligent design sphere and runs a website that interprets scientific discoveries through the lens of intelligent design. His father wrote an anti-evolution book and founded a Christian outreach group.

Coppedge also is a board member for Illustra Media, a company that produces video documentaries examining the scientific evidence for intelligent design. The company produces the videos that Coppedge was handing out to co-workers, Becker said.

Cancer bound: How some carcinogens evade removal by stabilizing the very DNA they attack

ScienceDaily (Nov. 2, 2012) ? A person doesn't have to go far to find a polycyclic aromatic hydrocarbon (PAH). These carcinogen precursors are inhaled through automobiles exhaust during the morning commute, are present in a drag of cigarette smoke, and are part of any barbequed meal.

Once ingested or inhaled, these big, bulky multi-ringed molecules are converted into reactive carcinogenic compounds that can bind to DNA, sometimes literally bending the double helix out of its normal shape, to form areas of damage called lesions. The damaged DNA can create errors in the genetic code during replication, which may cause cancer-initiating mutations.

It is the job of the nuclear excision repair (NER) system to repair damage caused by PAH lesions by removing the segment of DNA where the lesion is bound and patching up the resulting gap. But some lesions are especially resistant to this repair machinery, making them much more likely to cause mutations than lesions that are promptly repaired.

A research team at New York University (NYU) has gained new insight on the ability of certain PAH-derived lesions to evade the DNA repair machinery. They found that some lesions stabilize the DNA they damage, making it difficult for a certain repair protein to mark the lesion for repair. Their research was published earlier this year in the February 2012 issue of Biochemistry. More recent articles about NER of DNA lesions from the same group appeared in Nucleic Acids Research in July and August.

"Some lesions cause DNA to be locally destabilized, but there are lesions that actually stabilize the DNA so that the two strands come apart with great difficulty," said Suse Broyde, a biology professor at NYU. "Sometimes they're even more stable than undamaged DNA."

The stability of the DNA double helix is a key feature that determines whether DNA is flagged for repair in the first place by a protein called XPC. The protein patrols the genome looking for weakened areas. When it finds one, it slips a structure called a beta-hairpin between the strands, marking the DNA for NER. But if a lesion makes DNA more stable, the strands become more difficult to separate and the beta hairpin can't signal for repair.

How can molecules as large and disruptive as a PAH stabilize DNA in the first place?

"If you remember from chemistry, every kind of molecule interacts with other molecules through so-called Van der Waals interactions," said Nicholas Geacintov, a chemistry professor at NYU. "The DNA and the carcinogen bound to it also have the same kind of interactions," he said, specifically referring to the PAH-derived lesions that intercalate, or wedge themselves, between DNA base pairs.

The role of Van der Waals forces, which Broyde calls "stacking interactions" for these systems, was made clear through a series of computer simulations performed, analyzed, interpreted and visualized by Yuqin Cai, a post-doctoral senior research scientist in Broyde's lab. "The computer simulations revealed the structural, energetic and dynamic properties of the DNA containing the PAH-derived lesions, " said Broyde, who specializes in providing a mechanistic understanding of complex biological processes using molecular dynamics simulations and other front-line computational approaches.

"You can make movies of the dynamic trajectory which allow you to see the real mobility of the entire system," Broyde said. "You can watch the DNA flexing and the backbone moving dynamically and the carcinogen moving in and out. It's not rigid -- you can see its aliveness."

Broyde and her team's simulations revealed that of the six different lesions examined (three chemicals with two different geometric configurations each), those caused by dibenzo[a,l]pyrene, the most tumorigenic PAH investigated, were the most resistant to repair. The five-ringed structure of the carcinogen provided ample stacking opportunities, which stabilized the DNA much better than the four and three-ringed structures of the other PAHs that were examined.

Knowing which lesions are the most repair resistant could play an important role in preventative medicine, said Broyde, as individuals harboring them could be counseled to avoid further exposure, particularly in the case of smokers.

The atomic-level visualizations Broyde's lab simulated explained data gathered from experiments that are carried out in Geacintov's lab, including synthesis of the damaged DNA, measurements of its stability, and investigations of the relative NER susceptibility of lesion-containing DNA in human cells.

"Without experiments they wouldn't have anything to model and without modeling it would be very hard for us to understand what we are measuring," Geacintov said.

Some of the most important results came from DNA melting experiments, where a specific sequence of double-stranded DNA was synthesized with a known lesion and then heated up until the strands separated. The more stable the DNA, the higher the temperature at which it melted. The most stabilizing lesion melted nearly 10 degrees higher than the melting temperature of DNA with no lesions; this lesion was the most repair-resistant in experiments and also most stabilizing according to molecular simulations.

To compute the raw data (coordinates of structures as a function of time) for the analyses and visualizations, the Broyde lab used the Longhorn, Lonestar and Ranger high-performance computing resources at the Texas Advanced Computing Center as well as other systems in the Extreme Science and Engineering Discovery Environment (XSEDE).

Uncovering the stabilizing properties that allow some lesions to evade NER and initiate cancer could help develop better chemotherapeutic drugs to fight the disease, according to Broyde and Geacintov.

For example, the widely used chemotherapy drug, Cisplatin, attacks the DNA of cancerous cells, interrupting unregulated replication. However, the cell's own NER machinery can combat the drug by removing it and repairing the genome, just as in healthy non-cancerous cells.

"One direction in drug design is to find pharmaceuticals that still inhibit replication but that are less susceptible to NER," Broyde said. "Understanding the mechanism of NER will be valuable in designing the next generation of chemotherapeutic agents. These would be more effective if they were more resistant to NER."

Social-gaming companies to use platform for expansion into real-money gambling in competition with Zynga

The London, UK-based online gambling start-up Betable was in the news again Wednesday, reporting that it has secured deals for its software platform with three social gaming companies anxious to cover the online gambling for real money sector in competition with Zynga, which plans to start UK operations early next year (see previous reports)..

Slingo Inc., a developer of virtual-wagering slots and bingo titles that attract 54 million monthly users worldwide, will use Betable's U.K. gambling license and technology, along with Digital Chocolate Inc., started by Electronic Arts Inc. and Murka Ltd., the maker of Slots Journey, a statement from Betable announced.

Zynga and internet gambling group Bwin.Party Digital Entertainment partnered up just last week, initially with an entry into the UK online gambling market in mind.

On Wednesday a Betable spokesman said the company specialises in securing licensing and providing a flexible and versatile platform that is easily integrated with operator systems for quick implementation.

Slingo CEO Rich Roberts said that his company's goal would be to transition online players into gamblers of its content. Betable gives us an opportunity to move a little bit quicker than we could on our own, he noted.

Betable chief exec Chris Griffiths says online gamblers typically spend about $75 to $100 a month. Bearing in mind the massive numbers of social gamers, even a small percentage of these converting to real money gambling could deliver substantial revenues....but the field is becoming increasingly competitive.

That said, recent research from the NPD group suggests that there has been a decline of around 5% in US social game play, triggering attempts by the more alert companies to revive interest... and offering real money gambling and prizes may be a vehicle to help achieve this.

Betable presents a turnkey solution, handling the infrastructure, payment system, licenses, anti-fraud procedures and verification. Its platform suits desktop and mobile devices compatible with Android, iOS or Google technology.

Earlier this week Seattle gaming developer Big Fish Games announced a partnership with Betable to launch iPhone app. Big Fish Casino, with real-money betting in the UK.

Altman To Chair Board Of New Cost-Control Health Policy ...

The Patrick administration just announced that Prof. Stuart Altman, a Brandeis economist who advised President Nixon on health policy, will chair the Health Policy Commission, the new board overseeing the sweeping cost-control law.

The board will monitor progress toward keeping health care spending in line with state economic growth overall. Altman says he?s hopeful the state can meet this goal.

WBUR?s Martha Bebinger asked Altman a few questions about the post.

Bebinger: How do you see this new role?

Altman: Massachusetts has put together the best kind of balanced program that I could think of in the country, where it is relying at one level on the many changes that are going on in the private sector, both at the delivery system and at the payment system.?But it also has put together an overarching public assessment of what?s going on to make sure that it works, and it actually brings cost down without hurting quality.

If the changes that are currently in place don?t do that, this commission is responsible for giving an early warning sign that the system is not working and makes recommendations on how to make the system work.?So we don?t have direct regulatory power to force the system to change, but we do have a monitoring role to make sure that it is working and if it?s not, first to direct the delivery system and the payers to change, and if that doesn?t work, we could also recommend back to the Legislature that the state needs more authority.

What is your sense going in about whether things will proceed without too much intervention, or whether you will need to be directive?

One level I?m pretty optimistic.?The level of changes that are occurring in the state are really very substantial.?And I would say that both at the delivery system and including our very big delivery systems they really are seriously trying to restructure their care delivery and really trying to live within a tighter budget than they had in the past.?And the payers too, Blue Cross, and Tufts, and Harvard also, are tightening up the reins and not giving big increases.

So I go into this feeling reasonably optimistic, but I?ve been around a long time and I?ve seen other years and other decades when after a while the cost containment mechanisms in place began to fall apart, and did fall apart.?So while I?m going into this quite optimistic, I also have a degree of skepticism so I?m going to be watching it pretty closely.

You have seen interest in reining in costs wax and wane. How do you rank this period?

If we look back in history we had very strong government regulation environment in the early and middle 1970s, actually put forward by a Republican administration. It looked like the government was going to be a very strong regulator of growing health care spending.? We had wage and price controls from ?71 to ?74.? We created health planning agencies all over the country. We had tough certificate of need laws. And then as we move through the 70s we gradually dismantled it all and by the end of the 70s it was all gone.

Then we had a very brief period when the providers had what we called a ?voluntary effort? to control their spending.?All that fell apart and we had the biggest growth in our history in the 1980s.?Then we introduced managed care, which was extremely effective in slowing the growth in spending, but it was perceived by the patients ? and the beneficiaries and the press ? as a system that was holding back access and quality and we had this strong backlash and we essentially destroyed managed care by the end of the ?90s. So I?ve seen both the private sector fall apart and the government sector fall apart.

Now, I think what?s being done is smarter, and not quite as aggressive as the ?90s, which I think is a good thing. If you?re too aggressive you?re going to get a lot of backlash too quickly.?So I give it a higher probability of success than either the ?90s or the ?70s, and I am hopeful.

What?s your main worry?

The main worry is two:

1)?Is that ultimately the constraints begin to hurt certain segments of the provider community, [and they] begin to put out statements to the patients that they?re being denied needed care and we begin to develop a new backlash. So I think patients need to be part of this equation and we need to be balancing their needs with the people that pay the bills, so that?s one side.

2)?Massachusetts can only be so far ahead of the rest of the country and if inflation really begins to rear its head again in the rest of the country, the likelihood that Massachusetts would be able to really have a significantly lower level of spending growth is hard to hold on to.?I?m going to be very conscious of trying to minimize any backlash and I?ll also be watching what?s going on in the rest of the country.

For patients, are things moving along now in terms of communicating clearly with patients as you think they should?

No. I don?t think patients really understand these limited networks and tiered networks and ACOs and the like.?I think there needs to be an expanded consumer education program.?Also I think we need to do it smarter and I think tiered networks that are a better model than limited networks, in the sense that you don?t force a patient into any one delivery system, you just make it more expensive if they jump out of one to the other, which continues to gives them the choice.?What happened in the ?90s is that often they had no choice, they had to be at a particular network and they couldn?t jump out.

So I think we?ve learned something in the last 20 years.?If we?re going to ask organizations to have responsibility for total spending of a particular patient population, [the patients] need to know they?re in a particular group, but they also need to have the flexibility if for some reason they want to get out. I think we need to better educate our consumers and patients, but I think we?ve also learned from the ?90s, so I?m hopeful.

China's supercomputer development is as much driven by national reputation as by military prowess and science; the country chose to build the Sunway BlueLight MPP with domestic chips knowing that it wouldn't get the absolute performance crown. It won't be quite so modest the next time around. China's National University of Defense Technology wants the Tianhe-2 supercomputer due in 2015 to crack an extremely high 100 petaflops, or five times faster than the record-setting Titan over in the US and a whopping 40 times faster than the Tianhe-1A. Before we hand the crown over, though, Top 500 supercomputer chart keeper Jack Dongarra notes to ITworld that China might have to sprint if it wants the symbolic title: the EU, Japan and US are all striving for the same benchmark, and they're not backing off anytime soon. The nation's trump card may have to be long-term plans for an exaflop-strength supercomputer by 2018, at which point we suspect the bragging will simmer down. For awhile.
