Could third-party candidates sway presidential race?

Jim Cole / AP file

Former New Mexico Gov. Gary Johnson, who failed to win the GOP presidential nomination, is now running as the Libertarian candidate.

By Michael BeckelCenter for Public Integrity

Dark-horse presidential candidates Gary Johnson and Virgil Goode may not be household names, but with a little help from super PACs, they could peel away precious support from Republican Mitt Romney and possibly even President Barack Obama in some key state races.

The conservative Constitution Party, which seeks to ?restore American jurisprudence to its Biblical foundations,? has nominated Goode, a former congressman from Virginia, for president, potentially taking votes away from Romney in what has become a presidential swing state.

Meanwhile, Johnson, a former two-term GOP governor of New Mexico who failed to win the 2012 Republican presidential nod, has been nominated by the Libertarian Party ? a perch from which he could throw a wrench in the plans of both Obama and Romney in several swing states.

Already, at least three pro-Libertarian super PACs have registered with the Federal Election Commission to support Johnson. And former Nixon administration operative Roger Stone, famous for sporting a tattoo of the disgraced president on his back, has touted a pro-Johnson super PAC.

Super PACs are allowed to collect unlimited contributions from individuals, unions and corporations to produce political advertisements that are not coordinated with any candidate. They were made possible in the wake of the U.S. Supreme Court's Citizens United decision.

Goode, a staunch supporter of the 2nd Amendment and vocal opponent of abortion, served six terms in Congress ? first as a Democrat, then as an independent and finally as a Republican, until he was unseated in 2008. Third-party candidates like Goode have no chance of winning the White House, but one only need look to the 2000 presidential election to be reminded of their potential impact.

Former Virginia Rep. Virgil Goode speaks near the Washington Monument during a rally sponsored by the Minutemen Project in June 2007.

When consumer advocate Ralph Nader ran as the Green Party?s candidate, he infamously garnered more than 97,000 votes in Florida, where Democrat Al Gore lost to Republican George W. Bush by just 537 votes. Florida?s 25 Electoral College votes secured the presidency for Bush, even though Gore won the national popular vote.

One recent poll showed Goode drawing 9 percent of the vote in his home state of Virginia, whose 13 Electoral College votes are being sought by both Romney and Obama.

Similarly, a recent poll showed Johnson ? an anti-war candidate who supports marijuana legalization and smaller government ? receiving 5.3 percent of the national popular vote. That makes him an afterthought as a presidential candidate, but he may still have an impact in battleground states like New Mexico, Colorado, New Hampshire and even North Carolina.

Third-party candidates aren?t always suggested as options in polls. But one survey earlier this summer showed Johnson winning 12 percent of the vote in New Mexico, a state that Obama carried handily in 2008, but where Bush eked out a narrow victory in 2004.

GOP rabbi calls Adelsons 'heroes' after getting $500,000 for super PAC

Johnson garnered 7 percent of the vote in a May poll in New Hampshire, which Obama won easily four years ago but Bush carried in 2000. Earlier this month, Public Policy Polling showed Johnson pulling 7 percent of the vote in Colorado, where Obama was the first Democrat since Bill Clinton to win the state. Johnson is also polling at 3 percent in North Carolina, another swing state.

Super PAC spending on behalf of minor-party candidates like Johnson or Goode ?definitely could happen,? said Rob Richie, executive director of the nonprofit FairVote, which advocates for increased ballot choice.

?Most people have made up their minds between keeping Obama or going to Romney,? Richie continued. ?Some people, though, ? if they realized that there was another candidate running, might abandon one of the major-party candidates.?

Will super PACs promote increased choice?
Officials with both the Obama and Romney campaigns declined to comment about whether they were concerned about the role super PACs touting third-party candidates could play in the presidential race.

Some third-party activists, though, are keen to harness super PACs ? and their ability to raise unlimited funds, which they argue could increase the visibility of their preferred candidates.

?I wish we had super PACs out there supporting our candidates,? said Jim Clymer, who was the national chairman of the Constitution Party until April. He is now Goode?s vice presidential running mate.

?A couple of people who believe deeply in what we?re trying to promote could put us on the map in a way that we haven?t been,? he added. ?The reality is that getting your message out takes a lot of money.?

His sentiments are echoed by Libertarian Party activists.

?A libertarian candidate like Gary Johnson doesn?t have the infrastructure behind him that the major-party candidates have,? said Austin Cassidy, the treasurer of the pro-Johnson Libertarian Victory Committee super PAC, which was formed in May.

?If voters have the chance to compare him on an even playing field that could really spark something,? Cassidy continued.

Cassidy?s Libertarian Victory Committee raised only $200 ? all from Cassidy?s own pocket ? before throwing in the towel earlier this month, but the pro-Johnson Libertarian Action Super PAC has raised $107,500 as of the end of June. The bulk of that money ? $100,000 ? came from wealthy entrepreneur Joe Liemandt, the Stanford University dropout who founded and runs the software company Trilogy.

Notably, Liemandt's wife Andra has bundled more than $200,000 for Obama's re-election efforts, and the couple alone has donated $107,400 to the Obama Victory Fund, which benefits Obama's campaign and the Democratic National Committee. Together, they have also donated more than $130,000 to the Libertarian National Committee since 2009.

Wes Benedict, the former executive director of the Libertarian Party who is now the treasurer of the Libertarian Action super PAC, stresses that $100,000 in receipts is ?significant,? even if it?s dwarfed by the tens of millions of dollars raised by the pro-Obama and pro-Romney super PACs.

?In Libertarian terms, this is a big step forward,? he said. ?We?re in new territory running this super PAC,? he continued. ?I hope we make a difference.?

Since it was launched in April, Libertarian Action, which promotes ?low-cost, high-quality Gary Johnson materials? such as yard signs, bumper stickers and door hangers on its website, has reported making more than $16,000 in independent expenditures.

Another pro-Johnson super PAC, called Freedom and Liberty PAC, has also raised $100,000, though it has yet to make any expenditures touting Johnson or criticizing his rivals. The group was founded by one-time Johnson aide Kelly Casaday, and its sole donor is Chris J. Rufer, the founder of the Morning Star Company, a California-based agribusiness and food processing company.

The super PACs file their campaign finance reports with the FEC on a quarterly basis, so it?s unknown how much money they have raised since the end of the second quarter in June. A few wealthy donors could easily make them more flush with cash. At least one million-dollar contribution has been given to a pro-Johnson super PAC, according to Jim Gray, the Libertarian Party?s vice presidential nominee.

Not all third-party activists, though, think embracing super PACs is a good thing.

?(Super PACs) are squashing competition,? said David Cobb, who was the Green Party?s presidential nominee in 2004. ?When the wealthy elite can buy microphones and amplifiers and drown out the rest of us, it is supremely ridiculous to say that that somehow increases the competition of ideas.?

Good things or dirty tricks?
One person with the potential to make a large super PAC splash for a third-party candidate is longtime Republican operative Roger Stone.

Stone was the youngest staffer on Nixon?s infamous Committee for the Re-Election of the President, the group that financed the Watergate break-in. He later went on to work with the late Lee Atwater, the strategist who managed Republican George H.W. Bush?s 1988 presidential campaign against Democrat Michael Dukakis. And during the contentious Florida recount between Republican George W. Bush and Democrat Al Gore, Stone was dispatched to supervise the process.

Yet, in February, Stone, who did not respond to requests for an interview, said goodbye to the GOP and registered as a Libertarian after casting a vote for Ron Paul in the Florida GOP presidential primary.

In June, the Huffington Post reported Stone was constructing a pro-Johnson super PAC.

Tom Reed / AP

Roger Stone, shown in his Washington D.C. office in 1987.

?The American people have never been offered a candidate who is fiscally and economically conservative but socially tolerant,? Stone has said. ?With Gary Johnson, you can have the best of both.?

In his writings online, Stone stresses that Johnson has the potential to perform well in many battleground states, particularly in the West ? and that Johnson has the potential to win over both supporters of Obama and Romney.

Stone?s name has not yet appeared in any FEC super PAC filings and, so far, his new Libertarian Party allies are cautiously optimistic about his planned endeavors.

?Hopefully he?s up to good things and not dirty tricks,? said Benedict, the former Libertarian Party executive director.

Most political observers argue that outside groups are unlikely to change the fundamental calculus that makes a third-party presidential bid an uphill battle.

Americans Elect is a prime example, according to political science professor Larry Sabato, the director of the Center for Politics at the University of Virginia. The organization launched in 2010 with the hope of getting a centrist political candidate onto the ballot in all 50 states. The group raised more than $35 million ? including $5.5 million from billionaire hedge fund investor Peter Ackerman ? but it failed to find a willing candidate and has since retreated from the limelight.

?A super PAC can only sell a candidate if there's a market for him or her,? Sabato said. ?I don't think there is one in this highly polarized year.?

But as Democrats learned in 2000, a third-party candidate need not be a threat to win to have an impact.

Leaders often use rousing speeches to evoke powerful emotions, and those emotions may predict when a group will commit an act of violence or terrorism, according to new research published in the journal Behavioral Sciences of Terrorism and Political Aggression. Analysis of speeches delivered by government, activist and terrorist leaders found that leaders' expressions of anger, contempt and disgust spiked immediately before their group committed an act of violence.

"When leaders express a combination of anger, contempt and disgust in their speeches, it seems to be instrumental in inciting a group to act violently," said David Matsumoto, professor of psychology at San Francisco State University.

As part of a five-year project funded by the U.S. Department of Defense's Minerva Initiative, Matsumoto and colleagues studied the transcripts of speeches delivered by the leaders of ideologically motivated groups over the past 100 years. The analysis included such speeches as Osama bin Laden's remarks leading up to the bombings of embassies in Kenya and Tanzania.

The researchers analyzed the pattern of emotions conveyed when leaders spoke about their rival group and examined speeches given at three points in time before a specific act of aggression. They compared the results with the content of speeches delivered by leaders whose groups engaged in nonviolent acts of resistance such as rallies and protests.

Among leaders of groups that committed aggressive acts, there was a significant increase in expressions of anger, contempt and disgust from 3 to 6 months prior to the group committing an act of violence. For nonviolent groups, expressions of anger, contempt and disgust decreased from 3 to 6 months prior to the group staging an act of peaceful resistance.

Matsumoto says the findings suggest a leader's emotional tone may cause the rest of the group to share those emotions, which then motivates the group to take part in violent actions.

"For groups that committed acts of violence, there seemed to be this saturation of anger, contempt and disgust. That combination seems to be a recipe for hatred that leads to violence," Matsumoto said.

Anger, contempt and disgust may be particularly important drivers of violent behavior because they are often expressed in response to moral violations, says Matsumoto, and when an individual feels these emotions about a person or group, they often feel that their opponent is unchangeable and inherently bad.

"Understanding the preceding factors that lead to terrorist attacks and violent events may help predict these incidents or prevent them occurring in the first place," Matsumoto said. "Studying the emotions expressed by leaders is just one piece of the puzzle but it could be a helpful predictor of terrorist attacks."

    Railway

We need to transform how we think about transport and devolve power away from Whitehall, writes Alex Burrows

A fundamental lack of vision and coherent philosophy is holding back Britain?s approach to transport. To succeed, a clear narrative is needed explaining why transport is important and justifying its cost and value to society, together with a plan to turn vision into policy. The current government has dithered over high speed two and new airport capacity, and has no clear story to tell about where rail and aviation fit into a national long-term plan.

The ability to move around freely and easily is critical to all aspects of our daily lives. It connects us with jobs, skills, health, recreation and more, and, as such, it is not an optional extra. Good, well-designed transport can promote two key areas of policy: job creation and economic growth as well as carbon reduction and related environmental benefits. And, as transport infrastructure takes a long time to deliver, we must have a clear idea of how we intend to do so.

Under the present situation the Department for Transport enjoys full control from the centre and places a clear emphasis on transport investment taking place along a narrow cost-benefit assessment without inquiring into the wider economic benefits of investment in major infrastructure. The department approves or rejects major transport schemes proposed by local areas. This leads to overpromising on schemes both in terms of cost and benefit as areas compete to secure precious funding for infrastructure.

To transform this, power and funding needs to be devolved to regional and local bodies which have the knowledge and accountability to manage and deliver the strategic requirements of their area.

Earlier this year Labour released its policy review document, Empowering Communities to Improve Transport. Importantly, this recognised the issue of powers and the need for real devolution. As such, it represents a true break from previous practice.

Transport networks focus around major urban areas and spin out from there into suburban and rural areas. The building blocks for regional transport bodies should therefore be major conurbations encompassing the city-region, the journey-to-work area and the rural areas beyond, which have particular needs in themselves. City-regions must take the lead on transport provision for their areas through regional transport bodies that can balance the interests of the urban heart with rural areas that have different needs and problems. Local areas need particular focus within the regional bodies but to be able to devolve effectively there needs to be a critical mass of money, expertise and powers to wield sufficient clout to make devolution truly effective and efficient.

We should further empower our regional transport bodies to be able to raise their own money for infrastructure investment as well. If an authority has assessed that a new tramline will generate certain economic benefits for the area, then let the area raise a local tax, charge or levy to let it realise the benefits.

Whatever its faults, London?s transport authority, Transport for London, has demonstrated a number of successes in this regard: it has shown that cities can govern themselves responsibly; can identify, plan and deliver successful major transport schemes; that such schemes bring significant economic and social benefits; and that transport powers and funding can be effectively devolved. On a related note, London also has bus franchise powers which have created a hugely improved and more popular bus network while bus use elsewhere in the country has plummeted.

Devolution should also be the principle guiding how we manage our railways in future. We currently have a rail network that is far more expensive than its European counterparts to build and maintain, that is fragmented and that no longer considers rail a public good above all else.

The implication of reconceptualising rail as a public good once more is that the public sector should take a more active role in funding, promoting and delivering a rail network for the benefit of everyone, whether they choose to use it or not, rather than putting more burden on farepayers alone as is currently the case.

Currently we have rail services that are not aimed at delivering the best passenger experience. What is lacking? A standard, transparent approach that people can understand wherever they are on the rail network. We need to have standard peak hours, fare and ticket types, information provision, and a national smartcard or smartphone app for all transport ticketing, better integration of information, fares and timetabling across different services and also across different modes of transport. Private train operating companies have brought real benefits to the rail industry but they take profit out of the network, and, by competing with one another, have blocked a uniform approach at the expense of passengers. The franchise system prevents long-term planning and investment and gives no real role to passengers, the users whose communities rely on decent transport accessibility.

A new way of organising the delivery of rail services must recognise the different operations ? from passenger services to freight, intercity to local and regional services ? that coexist under the umbrella heading of ?rail? and give passengers a real say in them. And, if the country is paying for costly and long-term infrastructure investment, then government must own the assets it is investing in.

First, intercity, high-speed services need a specialist operator focused solely on delivering these services nationally. These equivalents of airline flag carriers are more profitable but are also crucial to the economic wellbeing of our major towns and cities. Intercity services at present include the West and East Coast main lines, the Great Western and East Anglian main lines and the Cross Country and TransPennine long-distance routes. A strong, unified and consistent brand for these services would become the iconic element of train travel. As intercity, high-speed services are of fundamental importance to national, regional and local economic policy as well as to transport policy, these must be run by an alliance of local and national government along with other key stakeholders in consultation to ensure we get maximum benefit from the provision of these services.

Second, local and regional services, so vital for the economic and social wellbeing of cities, towns and communities across the country, should be run by the regional transport bodies that can use the power and funding devolved to them to manage and deliver services.

Third, there are rural services and branch lines, such as the North Norfolk railway and the Tarka line in Devon, which have traditionally been squeezed out or ignored but which are vital arteries for many local people as well as tourist opportunities. These lines should be given the option to be derogated out as truly led and run by users, supported by their regional transport authority.

In all of these operations passengers and communities must be represented in the actual running and delivery, not as consultees, but fully involved and accountable. The local, regional and branch line services could be run as cooperative organisations, or by a specially created local public-private partnership operating company, or the transport authority could give a franchise to a private operator to deliver the services. Ultimately, the local area can determine what is best.

For too long transport has been seen as too difficult, too expensive, and too long term. That must stop. Transport is too important to leave to chance. Not only because ?growth? is the political challenge of the time, but partly because it is, we must put in place a long-term strategy that delivers for passengers and communities first.

Flu is transmitted before symptoms appear, study in ferrets suggests

ScienceDaily (Aug. 29, 2012) ? Research at Imperial College London examining influenza transmission in ferrets suggests that the virus can be passed on before the appearance of symptoms. If the finding applies to humans, it means that people pass on flu to others before they know they're infected, making it very difficult to contain epidemics.

The research was supported by the National Institute for Health Research (NIHR) Imperial Biomedical Research Centre.

Knowing if people are infectious before they have symptoms is important to help authorities plan for an epidemic, but is has been difficult to establish this from data collected during outbreaks. Previous research using mathematical models estimated that most flu transmission occurs after the onset of symptoms, but some happens earlier.

The new study, published in the open access journal PLoS ONE, is the first to investigate this question experimentally in an animal model. Ferrets are commonly used in flu research because they are susceptible to the same virus strains and show similar symptoms to humans.

Ferrets with flu were put in contact with uninfected ferrets for short periods at different stages after infection. Transmission occurred before the first symptom, fever, appeared, both when the ferrets were in the same cage and when they were in adjacent cages.

Professor Wendy Barclay, the study's lead author from the Department of Medicine at Imperial College London, said: "This result has important implications for pandemic planning strategies. It means that the spread of flu is very difficult to control, even with self-diagnosis and measures such as temperature screens at airports. It also means that doctors and nurses who don't get the flu jab are putting their patients at risk because they might pass on an infection when they don't know they're infected."

The flu strain used in the study was from the 2009 swine flu pandemic, which killed almost 300,000 people worldwide.

The researchers found that ferrets were able to pass on flu to others just 24 hours after becoming infected themselves. The animals did not suffer from fever until 45 hours after infection and began sneezing after 48 hours. The results are consistent with earlier studies which found that sneezing is not necessary to transmit flu -- droplets of virus are expelled into the air during normal breathing.

In the late stages of infection, after five or six days, flu was transmitted much less frequently, suggesting that people can return to work or school soon after symptoms subside with little risk of passing flu on to others.

The first author, Dr Kim Roberts, who is now based at Trinity College Dublin, said: "Ferrets are the best model available for studying flu transmission, but we have to be cautious about interpreting the results in humans. We only used a small number of animals in the study, so we can't say what proportion of transmission happens before symptoms occur. It probably varies depending on the flu strain."

Computer Network, Systems, and Database Administrators Are in ...

If you?re looking for a fast-paced career that combines technology with creativity, check out the field of computer network, systems, and database administration. This dynamic career path reflects the increasing number of computer networks in business today.

In the workplace, computers and computer networks have become an integral part of everyday life. Nearly everyone who works in an office has a computer, and big companies may have thousands of workstations, each with a computer terminal. These computers don?t just sit on desks like little islands; they need to be linked together into one seamless operating system. The ways that computers are linked together include local-area networks (LAN), wide-area networks (WAN), network segments, and Internet and intranet systems. Networks can be very complex, and creating a network of computers is a task that must be performed by highly qualified personnel.

Network and computer systems administrators design, install, and support an organization?s computer network systems. Network and computer systems administrators work in a wide variety of organizations including professional offices, government organizations, small businesses, and large corporations. They analyze problems, maintain a company?s network hardware and software, and monitor networks to ensure their functionality. Administrators may plan, coordinate, and implement network security measures, and they may gather data to identify customer needs and then use the information to identify, interpret, and evaluate system and network requirements.

Systems administrators ensure that the design of an organization?s computer system allows all of the components, including the network, the computers, and software, to work properly together. They are often responsible for maintaining the network?s efficiency, and they monitor and adjust the network?s performance. They continually survey the current computer system to determine future network needs, troubleshoot problems reported by users and by automated network monitoring systems, and make recommendations for future system upgrades.

When the computers in the sales office crash, or when the finance people can?t access their networked spreadsheets, or when the warehouse cannot access the intranet to track a shipment, the company can become paralyzed. A network systems administrator is the person who can, and must, resolve these network issues. It?s an important position.

Education and training are key. A bachelor?s degree is required for many network and computer systems administrator positions. In addition, many employers will demand that applicants have specialized computer network training of the type that may be offered by a career college. The best way to explore your career training opportunities is to log onto a reputable online college directory and compare computer training programs. Choose the ones that are right for you and request free information from the schools. This will allow you to make the best choice for your career education.

Here are some of the program areas that are key to this career field:

? Computers and electronics ? Knowledge of circuit boards, processors, chips, electronic equipment, and computer hardware and software, including applications and programming.

? English language ? Knowledge of the structure and content of the English language including the meaning and spelling of words, rules of composition, and grammar.

? Mathematics ? Knowledge of arithmetic, algebra, geometry, calculus, statistics, and their applications.

? Administration and management ? Knowledge of business and management principles involved in strategic planning, resource allocation, human resources modeling, leadership technique, production methods, and coordination of people and resources.

The career outlook is excellent. According to the U.S. Bureau of Labor Statistics (BLS), in the current decade from 2008 to 2018 employment of computer network, systems, and database administrators is expected to increase by 30 percent, which is much faster than the average for all occupations. Demand for computer network administrators is expected to increase as companies continue to invest in new technologies.

Compensation can be generous. According to the BLS, as of May of 2006, the median annual earnings of wage-and-salary network and computer systems administrators was $62,130. Not bad!

If you?re looking for a challenging and rewarding career, check out computer network systems career training. It may open a new door to a bright future.

Who Decides Which Party Goes First?

    Republican National Convention, 1920.

    Republican National Convention, 1920.

    Moffett Studio/Kaufmann & Fabry Co./Library of Congress.

In baseball, the home team always bats last. In football, the visiting team gets to call the coin toss. In basketball, they jump for first possession of the ball.? But what about the American political system? What decides whether the Republican or Democratic National Convention goes first in an election year?

For now, incumbency. There?s no hard-and-fast rule governing the convention calendar, but since 1956, when Dwight D. Eisenhower held office, the party in control of the White House has traditionally gone second. Between 1864 and 1952, the Democrats routinely followed the Republicans. The one exception was in 1888, when POTUS Grover Cleveland?s Democratic Party preceded the GOP, which would nominate Benjamin Harrison. Before that, starting with the two parties? first nominating conventions in 1832, it was a bit of a toss-up.

Political parties, which go unmentioned in the Constitution, began to crystallize around the turn of the 19th century. At first a party?s presidential and vice presidential nominees were selected by a Congressional caucus, but over time, as the United States expanded, party members who didn?t hold seats in Congress wanted to be involved in the choice. The Anti-Masonic Party was the first to stage a convention, in 1831, followed a year later by the Republicans and the Democrats.

While a party?s presidential and vice-presidential nominees tend to be a foregone conclusion going into a modern convention, this wasn?t always the case. Until the 1950s, delegates didn?t know who their final nominee would be until a ?rolling roll call of the states? yielded a candidate with the required two-thirds majority. Not only were delegates far more divided in terms of which nominees they arrived supporting, but they were also permitted to switch their votes during the convention if a different presidential hopeful made an especially persuasive case. Back-room dealing and shady negotiation played a substantial role in the process. In fact, it wasn?t until 1968, when Democrats fully embraced the primary system (thereby committing delegates to vote for the winner of the state primary), and 1972, when Republicans jumped on the bandwagon, that conventions became the utterly predictable and bloodless ceremonies they are today.

Leading Cause of Adverse Medication Events | Senior Care Services

by Reed on August 27, 2012

    arizona_senior_caregiver

Q.???? I am 75 years old and just got out of the hospital after suffering some unexpected bleeding. The doctors said it was caused by my blood-thinning medication, which they say needs to be monitored more frequently now because of my age. I?m a little more worried about my health, but I told my two sons who live 400 miles away that I feel too good to go to a care facility. Any recommendations?

Your situation is not unusual. There are nearly 100,000 emergency hospitalizations each year for adverse drug events that involve U.S. senior citizens, according to a?Centers for Disease Control and Prevention study?published in the New England Journal of Medicine. Of the thousands of medications available to patients, a small group of blood thinners and diabetes medications caused two-thirds of the emergency hospitalizations, the report said.

The study used data collected from a nationally representative sample of 58 hospitals participating in CDC?s National Electronic Injury Surveillance System-Cooperative Adverse Drug Event Surveillance project.

Almost half (48.1 percent) of these hospitalizations occur among the elderly aged 80 years or older, and two-thirds (65.7 percent) of the hospitalizations were due to overdoses, or to situations in which patients may have taken the prescribed amount of medication but the drug had more than the intended effect on the patient?s body. Four medications, used alone or together, accounted for two-thirds of the emergency hospitalizations:

    • 33 percent, or 33,171 emergency hospitalizations, involved warfarin, a medication used to prevent blood clots.
    • 14 percent involved insulins. Insulin injections are used to control blood sugar in people who have diabetes.
    • 13 percent involved antiplatelet drugs, such as aspirin or clopidogrel, which prevent platelets, or pieces of blood cells from clumping together to start a clot.
    • 11 percent involved diabetes medications that are taken by mouth, called oral hypoglycemic agents.

You and your family could feel more at ease if someone regularly checks on you. Demystifying The Process Of Accepting Credit Cards As An Attorney

Accepting credit cards can be a very intimidating option to consider as a sole practitioner or small-firm attorney ? if you deal with collecting retainers from your clients?

The word ?merchant service? has developed an almost ominous connotation among solo professionals ? and for good reason. Most people associate the phrase with ludicrous fees, minimum transaction volumes, equipment rentals and restrictive contracts. And all too often, that notion is entirely justified.

In fact, several professionals simply choose to forget about accepting credit cards altogether ? because it?s just ?one less hassle? to deal with. Unfortunately, this can actually cost them quite a bit of business, whether they realize it or not. It?s been continually proven that providing your customers the option of paying with credit will increase sales (in this case, client volume) in practically every industry.

Furthermore, the main advantage for an attorney to accept credit cards wouldn?t so much be an increase in client volume as it would eliminate waiting for checks in the mail ? not to mention having someone make a bank run to get them deposited. And credit card payments don?t ?bounce? either!

The truth is that while there actually are some very affordable (and flexible) services available to solo professionals, they?re also very few and far between. And in most cases, they?re not easy to recognize.

So let?s explore some of the terms and terminology of the merchant industry so as to ?de-mystify? the process of choosing a merchant company that will effectively suit your practice?

?Statement Fees: Most merchant account providers will charge you to simply receive your billing statement. This normally costs $10.00 per month. This is, for the most part, a ?pointless? fee for the purpose of generating additional revenue for the merchant company as it much more than covers the cost of distributing a statement ? although, not all companies have a statement fee.

?Monthly Minimums: Several programs include a ?minimum?, which is not a minimum amount of sales volume, but rather it?s a minimum charge in regards to transaction fees. Normally, this is $25.00 per month. This does not mean that a $25.00 sale will waive the minimum.

?Transaction Fees: This is a flat-fee per transaction through your merchant account. This will typically be around $0.25 per transaction ? although different credit cards will themselves charge a transaction fee as well, such as American Express and Discover.

?The Annual Fee: The majority of merchant services will employ an annual fee, ranging from $45.00 to $95.00. Again, this is simply a premium for using the service.

?Program Fees: Also called the ?monthly fee?, this is simply a monthly premium ranging from $5.00 to $25.00 per month to accept credit cards via the merchant service in question.

?Discount Rates: Also known as the ?flat rate?, this is a percentage of every sale that is automatically commissioned to the merchant service, and split between them and their processor (if they?re a third party). This will range from 1.95% to 5.95%, depending on the nature of the service.

?The Cancellation Fee: The majority of merchant services do utilize a ?minimum term of duration? within their account contract. To cancel the contract before it?s term has expired will cost anywhere from $95.00 to $250.00, sometimes more.

?Equipment Lease or Purchase: In general, you?re required to either lease or buy the (expensive) equipment needed to process credit card ?swipes?. Leasing equipment can range from $29.00 to $79.00 per month, with an average term of 36 ? 48 months. These leases cannot be cancelled. In addition, you will be paying the relevant state tax on those payments ? and to top it off, most companies will charge an extra $3.00 per month or so for a ?Loss and Destruction? waiver. At the end of the lease, you must either return the equipment in good condition, or you must purchase the equipment for at its current market value. The purchase price will be something like 15% of the aggregate lease payments (for a 36-month term).

As you can clearly see, all of this can add up to a substantial amount of money ? and if you do default on the equipment lease, it will show up on your credit report.

Accepting credit cards doesn?t seem too exciting at this point, does it?

However, as I had mentioned previously, there are some affordable options within the merchant industry that actually cater directly to solo professionals and part-time business owners.

For example, did you know that you can accept credit cards ? without any equipment at all ? by simply using your cell phone (or blackberry)?

Not only is this type of system totally mobile, most of these services are uniquely affordable. One in particular, ?Accept by Phone?, costs only $5.00 a month with a discount rate of 3.95% on each sale. Such services are able to bypass all the other fees because of the way that transactions are processed ? and the automated call-in system literally allows the vendor to authorize and process the payment in real time within a matter of seconds.

Additionally, this service does not have a minimum term ? or a cancellation fee.

Glenn Garnes, attorney and webmaster of Lawyer Lounge, recently reviewed the mentioned service:

?I can?t tell you how many times I?ve been on the road, at the courthouse, or out of the office when someone wanted to make a payment, and I delayed my ability to accept it by having to ask them to send a check. I also can?t tell you how many times that check was late or never came in the first place.

?If you bill for your fees, or if you have a collections practice, this [type of system is the perfect way to increase your cash flow conveniently, and cost effectively, not to mention how it improves your profile in the eyes of your client.?

Now, even if you would be processing most of your payments at the office ? and if you needed equipment ? there are also a variety of cost-effective services that suit that need as well. Just make sure that you take a very close look at the terms and conditions of the service in question.

Remember that the most crucial element of any merchant service is the term (duration) of the contract. They may be offering free applications, low fees and so on, but make sure that it?s not because they plan on locking you into a two-year contract.

Unfortunately, this is how most merchant companies make their money.

However, you?re no longer at the mercy of the merchant industry, because you?ve just taken a ?behind the scenes? look at how the whole system really works. You can now investigate accepting credit cards from your clients with confidence, knowing that it truly is possible to make life easier ? not harder ? by allowing your clients to pay with credit.

    Especially those that are ?cash-strapped?.

It?s simply a matter of finding a service that caters directly to your needs as an attorney.

Chris Rempel is the marketing director of Accept by Phone ? the only merchant account that is built specifically for professionals like attorneys.

Find out how you can accept credit cards from anywhere for only $5.00 a month at http://www.accept-by-phone.com/attorneys.html

New Domain Extensions Set to Launch in 2013 | New gTLDs

What is a Top Level Domain?

    icann new domains 2012

A top level domain is the ending of your website address, for example: .COM, or CO.UK. The trouble is, most of the good top level domain names have gone. Research by Verisign Inc, discovered that there were almost a quarter of a billion registered domain names by 2012. Many of these websites are not actually in use, they were registered and parked by people who hope to re-sell them to legitimate businesses for a small fortune.

Local businesses will be able to benefit from city and geographical domain extensions such as .SCOT, .NYC and .TOKYO. Special interest domain names will also be available such as .SPORT, ART and .MUSIC. So by the late 2013/early 2014 there will be an abundance of domain name choices available and some will be relevant to your business.

    What Does ICANN Do?

ICANN is a non-profit organization and one of their roles is to enable competition and diversity online. They are also responsible for changing url numbers ? like 231.654.567.43 ? into names, such as amazon.com, and ensuring the system operates safely and securely on a global scale. If this system was not available, it would be impossible to remember website addresses.

After six years of discussions, ICANN, the domain name management system organization has approved the release of a huge number of top level domain names. So instead of being stuck with long domain names that are difficult to remember, businesses will now have a huge choice of domain names to use for their websites.

If This is Such a Great Thing Why Did They Wait Until Now?

The release of the new top level domains has been in the pipeline for 6 years. To ensure that this is all done fairly, ICANN have a Nominating Committee (Nomcom). This makes a lot of sense as it means that every geographic area, and other interested parties are represented on the committee. Unfortunately with a committee this size, it also takes a long time to reach a universal agreement that everyone is happy with.

In addition to members from each global geographic area, Nomcom is comprised of GAC (Government Advisory Committee) and various other members. These repesentatives include Registrars, Internet Service Providers, a group representing small businesses and a group representing large businesses and brand holders. There are various other groups, including sub-committees, who can make decisions when they believe there is a conflict of interest.

Because so many groups of people were involved, and each were keen to protect the interests of the areas they represent, it took years before an agreement was reached on the best way to deal with the new top level domains.

Finally businesses, organizations and communities will have access to excellent domain names by late 2013/early 2014.

How Will This Benefit Your Business?

Almost a quarter of a billion domain names are already registered. Many are not in use, but are simply parked by people hoping to sell the domains for a huge profit. This means it is virtually impossible to get a memorable and relevant .COM domain name.

The new top level domain names are the way forward for the internet. The old .COM domain names have no meaning, whereas internet users will identify with the new domains and recognise them when they are searching for what they want. Names like .MUSIC, .SPORT, .NYC and .SHOP have far more meaning and searchers will easily be able to recognise what your business does, just by looking at the URL.

NASA to launch mini lab, test for cancer and disease in space ...

    DNP Microflow

It's hard to find a good specialist on earth, let alone when you're floating 240 miles above it. That's why NASA will test the Microflow, a breadbox-sized device that instantly detects cancer and infectious diseases, and can even sense the presence of rotten food. The Canadian-made device is a "flow cytometer," which works by analyzing microparticles in blood or other fluids and replaces hospital versions weighing hundreds of pounds. Here on Earth, the device could let people in remote communities be tested more quickly for disease, or permit on-site testing of food quality, for instance. It will be particularly advantageous in space, however, where Canadian astronaut Chris Hadfield will test it during his six-month ISS mission, allowing crew to monitor, diagnose and treat themselves without outside help. Now, if we could just get it down to a hand size, and use some kind of radio waves instead -- oh wait, that's not until Stardate -105352.

The answer is simple?get a personal trainer! Personal training is no longer just for the famous or wealthy. Instead, it has become an accessible option for anyone wanting to get on the fitness path, stay on it, and reach goals they may have previously thought impossible.

Kimberly Ouston, 29 years old, can certainly vouch for that. She works as a personal assistant and started personal training seven months ago when she signed up for a 10-week challenge at her local health club in Brisbane, Australia.

?The benefits of having a personal trainer have definitely been worth it. You find yourself doing things you thought you could never do, which in turn gives you a lot of confidence in yourself,? she explained.

?I started off by running on the treadmill at 9 kilometers [5.6 miles] per hour and am now able to run at 19 kilometers [11.8 miles] per hour, which is pretty fast for someone who has short legs! I am also now leg pressing just over 200 kilograms (441 pounds), which is over four times my weight,? she said.

    Getting Started

    \>");

Getting started with a personal trainer can seem somewhat daunting at first, as working with someone in a one-on-one situation can take a little time to get used to. However, you will have the trainer?s undivided attention, and a qualified and experienced personal trainer will tailor each session to suit your needs.

Finding the right personal trainer is similar to finding the right pair of jeans?you need to find the right fit.

Whether you start in a large gym setting or a smaller studio environment, in almost all cases, you will have the option of doing a starter pack of approximately three sessions to decide if personal training is for you.

Some places will even offer you a free session. Take it, as you will never know unless you give it a try. If you do decide the personal trainer is right for you, then you will have the choice to sign on for a period of time or a number of training sessions.

    Setting Goals

Personal training can help you achieve a myriad of goals. Your personal trainer will do a goal-setting session with you so you are both on the same page.

Your goal may be to lose weight, increase your cardiovascular fitness, compete in a triathlon, drop down a dress size, tone your arms, complete 100 push-ups, and the list goes on.

Having open communication is important so that your personal trainer knows exactly what you want.

Personal training is a definite way to fast-track your results, but always bear in mind that personal trainers are not miracle workers. They have the tools to get you where you need to go, but you need to follow their advice and the requirements they set for working out on your own.

Most personal trainers will give you nutritional advice and a program to follow to ensure you maximize your results.

Training with a personal trainer can be three times a week, more often, or as little as once a month. It all depends on how much motivation you need and what goals you want to achieve.

    Give It Time

Keep in mind, results don?t happen overnight. Give your body a good six weeks to start noticing a difference in your clothes and with your weight and overall strength and fitness level.

A testament to the benefits of personal training, Kimberly admits that although looking good is great motivation, it is the overall benefit to her work and home life she enjoys the most.

?The combination of cardio, weights training, and eating right has made a huge difference to my confidence and general positive outlook for life in general,? she said.

?I only see my trainer once a week, but find that I push myself even harder in the other exercise classes I do because I have learnt through my trainer that I can push myself harder and to never give up.?

If you are feeling a little stale and need some fresh ideas and a push in the right direction, or even if you have never set foot in a gym before, personal training is for everyone. So give it a go.

Amnesty: Gambia executes 9, more threatened

JOHANNESBURG (AP) ? The West African nation of Gambia has executed nine convicted criminals and dozens more on death-row are under imminent threat, Amnesty International said Saturday quoting credible reports.

Gambia's President Yaya Jammeh vowed earlier this month to execute all the country's inmates who had been sentenced to death as part of efforts to dissuade people from committing "heinous crimes" and to curb a rising crime rate.

Eight men and one woman were removed from their prison cells Friday night and executed, according to the London-based human rights organization. Two of those executed are believed to be foreigners from Senegal.

"More persons are under threat of imminent executions today and in the coming days," Amnesty said.

Gambia's information minister could not be reached immediately to confirm the report. There was no answer from his mobile telephone.

Amnesty said the executions are the first in Gambia since 1987. Gambia reinstated the death penalty in 1995 but had not executed anyone, former minister Omar Jallow has told The Associated Press.

Amnesty said there were 47 inmates on death row before Friday's executions: government figures put the number at 42 men and two women and another three men reportedly also received the death sentence this year.

Capital punishment can be imposed in Gambia for murder and treason. Three of those reportedly executed had been sentenced for treason, Amnesty said. It's not known how many of those on death row have been sentenced for alleged coup-plotting, a treasonable offense that could indicate Jammeh is using the executions to get rid of political opponents.

Jammeh was reelected in November in elections that were "neither free nor fair," according to the U.S. State Department. Its annual human rights report criticized "the government's harassment and abuse of its critics, which resulted in a muzzled press and the death, torture, arrest and detention, and sometimes enforced disappearance of citizens."

Amnesty called the executions, if confirmed, "a hugely retrograde step" putting Gambia among a minority of African states that still impose the death penalty. Thirty-eight of the 54 members of the African Union have abolished the death penalty or, if it is still in their law books, do not perform executions, Amnesty International said.
