Op-Ed: Six-strike plan imposed by Internet Service Providers

Beginning this week, major ISPs will start spying on US Internet users. With the new program, its a case of "six strikes and you are out" if they think you are pirating copyright-protected content.
After months of discussion on the controversial program to be imposed by the largest ISPs in the US, the Copyright Alert System (CAS) confirmed on Monday this week that the "six-strike" program has now officially gone live. If you have an Internet connection via AT&T, Cablevision Systems, Comcast, Time Warner Cable or Verizon, its a case of six strikes, and you are quite literally out.


Opposed and critiqued by privacy advocates and Internet freedom activists alike, this program will allow ISPs to take six steps, of increasing severity, when handling incidents where their customers are believed to be illegally sharing online content.


Customers would receive a series of warnings, through a "graduate response" approach, for illegally downloading copyright protected material.


When CAS releases the first strike, a customer could be issued a warning. However, should the customer continue to violate policies, other mitigation measures will be introduced, including connection speed throttling right up to and including the possibility of final termination of service.


According to Wired, the various measures include ?temporary reductions of Internet speeds, redirection to a landing page until the subscriber contacts the ISP to discuss the matter or reviews and responds to some educational information about copyright, or other measures (as specified in published policies) that the ISP may deem necessary to help resolve the matter.? Ending with complete disconnection if the customer doesn't comply.


Apparently the plan does not just stop there. The Copyright Act also allows the user to be sued for damages of up to $150,000 per infringement.


Jill Lesser of the Center for Copyright Information explained the situation in a blog post on Monday. ?Practically speaking, this means our content partners will begin sending notices of alleged P2P [peer-to-peer] copyright infringement to ISPs, and the ISPs will begin forwarding those notices in the form of Copyright Alerts to consumers.?


?Consumers whose accounts have been used to share copyrighted content over P2P networks illegally (or without authority) will receive Alerts that are meant to educate rather than punish, and direct them to legal alternatives. And for those consumers who believe they received Alerts in error, an easy to use process will be in place for them to seek independent review of the Alerts they received,? she adds.


What she neglected to mention is that this appeals process costs customers $35 a pop.


CAS tried to get this going in July 2012. Gigi Sohn, president of digital rights group Public Knowledge, told Wired last year that originally ISPs hoped to roll out the program earlier, but major protests against other restrictive Web policies, including attempts to pass certain legislation, caused them to have to wait.


?SOPA and PIPA definitely had an impact. There was some concern, if they moved ahead too quickly, public opinion would be so raw, this would be caught in the whirlwind of bad PR,? Sohn told Wired.


According to the Electronic Frontier Foundation, the official six-strikes website allows users to learn more about the history of copyright. It does this by apparently re-directing them to a web page managed by the Copyright Alliance, which is the same group who advocated for last year's "Stop Online Piracy Act," more commonly known as SOPA.


Reportedly the White House has issued an official statement saying that the six-strikes program should ?have a significant impact on reducing online piracy.?


Demand Progress is running a petition where you can tell your ISPs "No 'Six Strikes' Plan - Or We'll Take Our Business Elsewhere." Smaller Internet service providers could find an increase in new business in the very near future.

In his monograph, Zoltn Peterecz presents the personality and work of Jeremiah Smith, Jr. (1870), the League of Nations Commissioner-General for the 1924 loan to Hungary. He deals also in extenso with the economic and political problems associated with the financial reconstruction of Hungary both on the domestic and international scene. Created in 1919, shortly after World War I, the League of Nations was principally designed to put an end to war. Palestinians bury man who died in Israeli custody

SAEER, West Bank (AP) ? A Palestinian man who died under disputed circumstances in Israeli custody was given a hero's funeral Monday, as thousands thronged his gravesite and Palestinian police fired a 21-gun salute.

Palestinian officials, citing an autopsy, said Arafat Jaradat was tortured during Israeli interrogation. Israeli officials said more tests are needed to determine the cause of death, and Israel's public security minister said he would allow an international expert to review the autopsy results.

The weekend death of the 30-year-old gas station attendant and father of two comes amid rising West Bank tensions that have prompted talk in Israel about the possibility of a new Palestinian uprising.

Israeli Prime Minister Benjamin Netanyahu's office said Monday he was consulting with security officials, while U.N. envoy Robert Serry warned that "mounting tensions present a real risk of destabilization."

In recent days, there have been frequent Palestinian protests in support of some 4,600 Palestinians held by Israel, particularly four inmates who've staged extended hunger strikes.

In a clash Monday, Palestinian medical officials said two Palestinian youths, one 13 years old and one 16, were seriously wounded by live fire. An Israeli military spokesman, speaking on condition of anonymity in line with military policy, said the military was looking into the claim. He said protesters hurled "improvised hand grenades" towards a holy site in the Bethlehem area, endangering the worshippers inside, at which point soldiers fired at the legs of one Palestinian, lightly injuring him.

Israel's military has said it typically uses non-lethal means to disperse violent protests, but occasionally uses live fire when soldiers feel they are in a life-threatening situation. In recent weeks, Palestinians have increasingly complained of the military's use of live fire at protests.

The fate of the prisoners is sensitive in Palestinian society, where virtually every family has had a member imprisoned by Israel. Detainees are held on a range of charges, from stone-throwing to deadly attacks, and are seen as heroes resisting occupation. Israelis tend to view them as terrorists.

Palestinian and Israeli officials traded accusations Monday, each saying the other was trying to exploit the latest unrest for political gains.

Palestinian President Mahmoud Abbas said Israel is trying to provoke the Palestinians with what he said are increasingly lethal methods by Israeli security forces clamping down on Palestinian protests.

"However they try to drag us to that place, we won't be dragged," said Abbas. "We won't be dragged, but they (Israelis) have to bear the responsibility."

Israeli government spokesman Mark Regev alleged that Abbas' self-rule government in the West Bank is inciting violence against Israel. Palestinian officials have called for more solidarity rallies for the prisoners.

Abbas, a critic of violence, has said he would not allow an armed uprising on his watch.

But tensions have been rising in recent days with a number of protests in solidarity with prisoners held by Israel, and then the death of Jaradat over the weekend.

At Monday's funeral, thousands marched behind Jaradat's body, draped in a Palestinian flag, as the procession snaked through his home town of Saeer, near the West Bank city of Hebron.

Palestinian police maintained order, and seven officers fired a 21-gun salute near the gravesite.

Abbas Zaki, a senior member of Abbas' Fatah movement, called Jaradat's death an Israeli crime.

"I am telling Fatah members that our enemy only understands the language of force," he told the crowd in what appeared to be a call to violence.

Jaradat was arrested on Feb. 18 on suspicion that he had thrown stones at Israelis. He died Saturday at Israel's Megiddo prison after several days of interrogation by the Shin Bet security service.

Israel's forensics institute performed an autopsy Sunday, in the presence of a physician from the Palestinian Authority.

The Palestinian minister of prisoner affairs, Issa Karake, said after being briefed by the Palestinian doctor that Jaradat was tortured. He said Jaradat was bruised over his body and suffered two broken ribs.

Jaradat's brother, Mohammed, said he saw the body Sunday and believed his brother was severely beaten.

Israel's Health Ministry said the autopsy did not conclusively determine the cause of death, but that the bruising and broken ribs were likely the result of attempts to revive the detainee. It said more testing was needed.

Amos Gilad, an Israeli defense official, alleged that Palestinian officials were jumping to conclusions. "It's intended to incite," Gilad told Israel Army Radio on Monday. "There is a clear political purpose to stir things up."

The Shin Bet initially said Jaradat apparently died of a heart attack, though the Palestinian physician attending the autopsy was quoted as saying he did not find any evidence of that.

An agency official has denied Jaradat was beaten.

Detainees have filed some 700 complaints about mistreatment by Shin Bet agents in the past decade, according to the Israeli human rights group B'Tselem.

Reports of physical mistreatment have dropped sharply in recent years but have not disappeared, said B'Tselem spokeswoman Sarit Michaeli.

Serry said Israel must respect its obligations toward all Palestinians in custody, adding that the U.N. is concerned about the deteriorating health of Palestinian detainees on hunger strike.

Music service Spotify hooks up with Ford in first vehicle foray

(Reuters) - Streaming music service Spotify has partnered with Ford Motor Co to allow its subscribers to listen to music in more than one million Ford vehicles in North America.

Owners of Ford models with SYNC AppLink can access Spotify's catalog of more than 20 million songs through voice activation using its smartphone app.

The deal, announced by both companies on Monday, is Spotify's first collaboration with an automaker.

Spotify is a free on-demand streaming music service that also offers a subscription package that allows listeners to hear music without interruptions from commercials and gain access to play lists and preferences from any device anytime.

Spotify says it has 20 million active users worldwide, with 25 percent of them paying for subscriptions.

Music services like Spotify and Pandora Media Inc

are striking partnerships with automakers to make their music available to drivers, especially as Internet access improves in vehicles.

Pandora is available in 75 vehicle models and has deals with automakers like General Motors Co , Ford, BMW and Chrysler Group LLC , allowing drivers to plug in their Pandora-enabled mobile devices and use car dashboards to control the service.

More than 1 million people have used Pandora's dashboard integration, it said.

Separately on Monday, GM said it was switching to AT&T Inc from Verizon Wireless to provide high-speed wireless service for its 2015 vehicle models.

Cardinal: LA's Mahony should help select pope

MENLO PARK, Calif. (AP) ? The former archbishop of San Francisco said Monday that Los Angeles Cardinal Roger Mahony has a rightful place among Vatican officials who will choose the next pope, even though Mahony has been battered in recent days by disclosures about his role in covering up clergy sex abuse.

The comments by Cardinal William Levada, a high-ranking Vatican official until recently, came in the wake of a grass-roots campaign to shame Mahony into refraining from participating because of his role protecting sexually abusive priests.

Mahony left for Rome over the weekend after recently released church documents showed he had covered up for other priests who raped and molested children.

"There are some victims groups for whom enough is never enough, so we have to do our jobs as best we see it," said Levada, 76, who spoke with reporters from a Menlo Park seminary as he prepared for his trip to the Vatican for the papal conclave.

"He has apologized for errors in judgment that were made," Levada said. "I believe he should be at the conclave."

On Monday, Mahony took to social media and his own personal blog to write about persecution and forgiving one's enemies. He said he has a special prayer group for people who "cannot forgive me for my past hurts and offenses," including members of the media, attorneys, protesters and those who "hate and despise me."

He also tweeted from Rome, writing: "Anyone interested in loving your enemies, or doing good to those who persecute you? See my blog for today. Wow, Jesus is demanding."

Levada said Cardinal Keith O'Brien's decision Monday to step down as archbishop of St. Andrews and Edinburgh and to opt out of the conclave will "provide the freedom to do a good independent investigation and decide on appropriate measures to take on this case."

Levada, who leaves for Rome on Tuesday, retired in 2012 after spending six years as the head of the Congregation for the Doctrine of the Faith, the Vatican's orthodoxy watchdog, which also defrocked pedophile priests.

He played a key role in several church sex-abuse reforms. While serving previously as an archbishop in California and Oregon, he kept some accused molesters in the church and failed to share some allegations with police or parishioners.

On Monday, Levada drew a sharp divide between gay men and pedophile priests.

"By nature homosexuality is a not a predatory activity, it is a sexual activity that the Catholic church does not condone," he said. By contrast, he said pedophile priests are violating the sanctity and purity of young people.

Levada also said bureaucratic reforms at the Vatican will require a lot of attention from the next pope. He said he'll be looking for a candidate with deep faith, someone who has shown leadership and has language skills. He said youth is also a factor, and he extinguished any rumors that the next pope might be from the U.S.

"I don't know what the Las Vegas oddsmakers are saying today," he said, "but I don't think it's likely that we would see an American pope. It would be an additional complexity for an American pope to have to deal with the perception that some of his decisions might be perceived to be dictated by American governmental policy."

Levada also said he respects Pope Benedict's decision to withhold findings from an investigation into Vatican leaks to cardinals voting on his successor.

"If his judgment is that there's nothing in that report that's necessary for the cardinals then I think we can rely on that," he said. "Pope Benedict is a man of very good judgment."

Levada and Mahony will join more than 100 cardinals on Thursday in Rome to begin the historical process that will choose a successor to Pope Benedict XVI, whose decision to retire took worldwide Catholics by surprise.

Levada, whose Vatican job was held by the former Cardinal Joseph Ratzinger before he became Pope Benedict XVI, said in all his years of service, he never anticipated being called to a conclave.

"Never. Never," he said. "It's very challenging. It's pretty exciting."

Prior to the election, the cardinals meet and discuss the qualities of the candidates.

"We begin to make some judgments," he said.

Then, in silence, the cardinals vote, sometimes repeatedly, tucking ballots into a closely observed box which is then openly counted in front of them.

Many Americans are still enamored with debt

The economy is slowly hobbling back to health, but for many Americans the rainy day fund is still looking a little dry and the credit card bill is still looking a little scary.

About 24 percent of Americans have more credit card debt than emergency savings, according to an annual survey released Monday by the personal finance website Bankrate.com.

The survey found that only about 55 percent of Americans have more emergency savings than credit card debt. About 16 percent had none of each, and the rest either didn?t know or wouldn?t answer.

The results are little changed from the same survey Bankrate.com did in 2011 and 2012. The results suggests that, in general, people?s ability to save up for a rainy day and keep a handle on credit card debt hasn?t gotten much worse in recent years - but it hasn?t improved, either.

Greg McBride, senior financial analyst with Bankrate.com, said a big problem is that people?s wages have been pretty stagnant in recent years, even as expenses for things like food and health care have edged up.

?It just leaves less money that can be put toward debt repayment or emergency savings,? McBride said.

Americans appeared to have been sobered by the Great Recession, and some people were able to get a better handle on their credit card debt in the years that followed.

The total amount of revolving debt, which is made up mostly of credit card debt, fell between 2008 and 2010, according to the Federal Reserve. Since then, it has held relatively steady at around $850 billion, the Federal Reserve data shows.

But those aggregate numbers don?t? tell the whole story, said Lucia Dunn, economics professor at The Ohio State University.

Her research has shown that some people were able to pay off their credit card debt around the time of the Great Recession. But those who weren?t able to get control of their debt during that period are likely still struggling with it, she said.

?For those who were not able to pay off (their credit cards) and were still carrying a balance, that balance is still growing,? said Dunn, who was not involved in the Bankrate.com survey.

Dunn said her data also has shown that people continue to have elevated levels of stress about their debt, even though the recession has officially been over since June of 2009.

??We may be out of the recession, but debt?s still a looming problem for people,? she said.

The Bankrate.com data also showed that saving up enough money for an unexpected emergency remains a thorny problem.

Nearly 4 in 10 people said they were feeling less comfortable about their savings levels than a year ago, while nearly half were feeling about the same. Only 14 percent said they were feeling better about their savings levels.

They Bankrate.com survey was of a representative sample of about 1,000 adults, and it was conducted in early February.

McBride, from Bankrate.com, said many Americans may have the goal of increasing their savings but find that they have little left over after the bills are paid.

?I think that people care about it. I think most of it is just sort of the inability to make substantive progress,? he said.

Still, McBride said he wasn?t sure that Americans will improve their financial habits once the economy improves For many Americans, he noted, thriftiness has been forced on them because their credit lines have been cut, they?ve suffered a job loss or they?ve hit another financial brick wall.

As the economy starts to strengthen further, he expects Americans will be more likely to spend their extra cash rather than save it.

?At the point where incomes do start to grow, I don?t think it means that the savings rate?s going to go up,? he said. ?I think it means that consumer spending is going to go up.?

Jason Kincaid On The Mythology Of TechCrunch

Jason KincaidI was happily surprised to see Hunter Walk interview Jason Kincaid, one of the first TechCrunch employees. The interview is here and I’m reprinting it below. Jason joined TechCrunch when it was still being run out of my house (before the city of Atherton kicked us out). Even after “retiring” he’s still no. 11 on the all time tech writers list. Jason broke a lot of big stories. But he also has the rare ability to write thought pieces that shape Silicon Valley culture and thinking. From the moment he joined he was part of the core backbone of TechCrunch. From the article I wrote when he resigned in 2012: Jason has the rare ability in a writer to both break big stories on his own, as well as write strong opinion articles on the topics of the day. Younger writers (who were often older than him) looked to him for leadership and guidance. He could have quite easily run TechCrunch entirely after we left. Kurdish leader calls talks 'historic step'

(AP) ? Imprisoned Kurdish rebel leader Abdullah Ocalan has called talks with Turkish officials aiming to halt a decades-long conflict a historic step and urged all sides involved to show "care and sensitivity."

His brief message was conveyed Saturday by three pro-Kurdish legislators who were allowed to travel to his prison island off Istanbul to confer about the peace process.

The government declared in December that it was holding talks with Ocalan with the goal of convincing the rebels to declare a cease-fire, withdraw from Turkey and disarm.

Legislator Pervin Buldan told reporters Ocalan also expressed hope officials and soldiers kidnapped by the rebels would soon be released.

Ocalan's Kurdistan Workers' Party, or PKK, is fighting for self-rule in southeast Turkey. The conflict has killed tens of thousands since 1984.

[iPad] Square Card Reader Not Working

Hi,

I was wondering if anybody has a similar problem or any tips to solve the problem.

I've been using Square Card Reader for about 3 weeks and all sudden, it stopped reading the cards. When I plugged in the reader, it says "Reader Connected" but it just doesn't read the card.

I've emailed Square customer service several times but always the same answers, reinstall the apps, restart iPad, etc etc... nothing works.

Reader works fine on my iPhone so I don't think it's a reader problem.

Any advice highly appreciated !

Boeing proposes full 787 battery fix to FAA

Boeing gave U.S. aviation regulators its plan to fix the volatile battery aboard its new 787 Dreamliner on Friday, even before investigators know what caused the batteries to overheat on two planes last month.

Boeing will not propose abandoning the lithium-ion batteries, however, and is not working on a backup or longer-term fix for the problem that has grounded its entire fleet of 50 787 Dreamliners, three sources familiar with the plan said.

The proposal, made to the U.S. Federal Aviation Administration, includes specific measures aimed at addressing possible causes of short-circuits that prompted one of the lithium-ion batteries on board a 787 to catch fire at a Boston airport in January, the sources said. A second battery smoldered during a flight in Japan a few days later, leading to an emergency landing and evacuation.

The proposal includes insulation between the cells of the battery and a stronger, stainless steel box with a venting tube to contain a fire and expel fumes outside the aircraft should a battery catch fire again, the sources said.

"I have talked to a number of people who are working directly on these batteries. No one is on the Plan-B team," said a person familiar with Boeing's efforts who was not authorized to speak publicly about them.

Boeing's proposal to the FAA is not a temporary "band-aid" that would be supplanted by another solution later, said a second source, who also was not authorized to speak publicly.

The FAA said in a statement Friday that it is reviewing Boeing's proposal. "The safety of the flying public is our top priority and we won?t allow the 787 to return to commercial service until we?re confident that any proposed solution has addressed the battery failure risks," the statement said.

Boeing declined to comment specifically on its proposal, and reiterated that hundreds of engineers and technical experts are working "around the clock" to return the 787 fleet to service. "Everyone is working to get to the answer as quickly as possible and good progress is being made," spokesman Marc Birtel said.

Five weeks after U.S. authorities grounded the worldwide fleet of 787s, U.S., Japanese and French investigators are still not certain what caused the battery fire aboard an All Nippon Airways 787 in Boston and an overheated, smoking battery on a Japan Airlines 787 in Japan.

The National Transportation Safety Board is still investigating the Boston fire and the Japan Transportation Safety Board is investigating the battery failure in Japan. Neither have found a root cause for the problems.

The sources said it is possible the NTSB might never determine the root cause.

One Direction set to play music's Brit Awards

LONDON (AP) ? One Direction, Justin Timberlake and Mumford & Sons are getting ready to perform at Britain's leading music awards, where nominees include the late soul diva Amy Winehouse.

Mumford & Sons, Emeli Sande and Alt-J lead the nominations for Wednesday's Brit Awards, with three each.

Winehouse ? who died in July 2011 from accidental alcohol poisoning ? is up for best British female artist. She is eligible thanks to her posthumous "Lioness: Hidden Treasures" album.

Other nominees include the Rolling Stones, up for best live act against Coldplay, Mumford & Sons, Muse and The Vaccines.

Trailer for ASUS MeMo Pad Smart 10 emerges, Tegra 3 and available in pink

ASUS has long been making Android tablets now, and they're often something worth taking note of. Their latest -- previously rumored -- slate, likely heading towards Mobile World Congress, has been unveiled by way of a YouTube trailer. Say hello to the ASUS MeMo Pad Smart 10. Catchy, isn't it? 

Unlike some past offerings from ASUS, the MeMo Pad Smart 10 doesn't break any new boundaries, or push the specs to the limits. But, what it looks like is a pretty solid 10-inch tablet. Oh, and it'll also be available in pink, if you're into that sort of thing. 

We don't get a whole lot of information from the clip, but we do find out that the tablet houses a Tegra 3 processor, a 5MP rear camera, and a 10-inch IPS display that promises some impressive viewing angles. We're also treated to SonicMaster sound technology, and a glimpse at some of the bundled software, although anyone familiar with ASUS tablets won't be too surprised by what we see. All this fits in with earlier, leaked information on the tablet, and at the same time isn't too surprising. Neither is the software, it's pretty much a given that we'll be looking at Jelly Bean, but as yet there's no confirmation on which version.

So, we're not looking at a bleeding edge tablet here, but what we are seeing is potentially a great value 10-inch tablet if it lands at the right price. We'll be on the look out next week in Barcelona, so keep it locked to Android Central in the days ahead for all the best from MWC 2013.

In an apparent move to gain Twitter followers, sister networks MTV and BET pretended hackers took over their accounts.
  
Tuesday's publicity stunt came after Burger King and Jeep had their Twitter accounts hijacked by hackers who switched their profiles to show information for their respective rivals McDonald's and Cadillac.
  
MTV and BET, which are owned by Viacom, pretended the same kind of hacking was happening to their accounts by switching profile photos and logos. MTV became BET, and vice versa.
  
The stunt lasted for about an hour until MTV tweeted: "We totally Catfish-ed you guys. Thanks for playing! &lt;3 you, @BET. ;)." That was followed by a tweet from BET that said: "#fakehackedswag !!! salute to @MTV for rockin this!"

Bill Gates 'not satisfied' with Microsoft's innovations

Although Bill Gates stepped away from his day-to-day role at Microsoft nearly five years ago, he still keeps a close eye on the company he co-founded -- and he isn't always happy with what he sees.

During a recent interview broadcast this morning on CBS This Morning, the Microsoft chairman was asked by Charlie Rose whether he was happy with Steve Ballmer's performance as chief executive. Nothing that there have been "many amazing things" accomplished under Ballmer's leadership in the past couple of years, Gates said he was not satisfied with the company's innovations.

"Well, he and I are two of the most self-critical people -- you can imagine," Gates said during the interview (see video below). "And here were a lot of amazing things that Steve's leadership got done with the company in the last year. Windows 8 is key to the future, the Surface computer. Bing, people are seeing as a better search product, Xbox."

"But is -- is it enough?" he said. "No, he and I are not satisfied that in terms of, you know, breakthrough things, that we're doing everything possible."

Gates was especially critical of Microsoft's position in the smartphone sector, where the company currently holds just 2.4 percent of the market, according to recent IDC data.

"There's a lot of things like cell phones where we didn't get out in the lead very early. ... We didn't miss cell phones, but the way we went about it didn't allow us to get the leadership. So it's clearly a mistake."

The primary focus of the interview was the Melinda and Bill Gates Foundation, the philanthropy to which Gates has dedicated most of his attention since stepping away from Microsoft in 2008.
